**Job Profile: Specialist Lawyer (Municipal, Real Estate, and Corporate Criminal Law)**
**I. Job Identification**
* **Job Title:** Specialist Lawyer / In-House Legal Advisor
* **Area / Department:** Legal / Legal Advisory
* **Reports To:** General Management / Head of Administration and Finance
* **Supervises:** Legal assistants, interns, and external law firms (outsourced law firms).
**II. Job Objective**
Ensure the legal viability and uninterrupted development of the company’s private construction projects. Advise on and manage the acquisition of licenses and permits from local governments; legally structure real estate marketing; and provide technical defense (preventive and reactive) in criminal contingencies or administrative sanctioning proceedings involving the company, its executives, or site personnel.
**III. Main Responsibilities**
**Municipal Management and Private Construction Projects (Real Estate):**
* Lead the acquisition, renewal, and defense of urban development and building permits before municipalities, as well as project acceptance procedures and factory declarations.
* Manage and defend projects developed under the **Social Interest Housing (VIS)** framework against obstacles or inspections by local governments, ensuring correct application of current regulations and ordinances.
* Draft and review legal structuring for project marketing (drafting purchase-sale agreements, minutes, and public deeds for apartments, parking spaces, and storage units).
* Assume technical defense in Administrative Sanctioning Proceedings (ASP) initiated by municipalities (fines, closures, work stoppages).
* Conduct physical\-legal due diligence on land parcels for future acquisitions and real estate developments.
**Corporate Criminal Defense and Compliance:**
* Provide preliminary technical defense and representation in tax investigations or criminal proceedings arising from construction activities (e.g., workplace accidents, negligent homicide, injuries, environmental crimes, land usurpation, or endangerment).
* Design and implement crime prevention models (Criminal Compliance \- Law No. 30424) to mitigate administrative and criminal liability of the legal entity.
* Advise site management and senior leadership on crisis management in response to serious accidents, SUNAFIL inspections, Crime Prevention Prosecutors’ offices, or police interventions.
**IV. Candidate Requirements**
**Academic Qualifications:**
* Licensed Lawyer, duly registered with the Bar Association and holding a valid license (Mandatory).
* Master’s degree, postgraduate diploma, or specialization in Municipal Law, Real Estate/Registry Law, or Corporate Criminal Law.
**Professional Experience:**
* Minimum general professional experience of **five (5\) years** practicing law.
* At least **three (3\) years** of specific experience working in-house for construction companies, real estate developers, or law firms advising the construction sector.
* Proven experience in criminal litigation and direct management of procedures before municipalities and public registries (SUNARP).
* Experience with Tax-Funded Projects (OXI).
**Technical Knowledge:**
* In-depth knowledge of Law No. 29090 (Law Regulating Urban Development and Building Permits) and its regulations.
* Solid understanding of the legal framework governing Social Interest Housing (VIS) and the Ministry of Housing’s regulations.
* Comprehensive knowledge of the Penal Code and the Criminal Procedure Code, focused on corporate, property-related, and crimes against life, bodily integrity, and health (workplace accidents).
* Advanced drafting skills for civil, commercial, and corporate contracts.
* Knowledge of Tax-Funded Projects (OXI)
**V. Soft Skills and Competencies**
